1. Daifuku collects the following types of personal data:

(a) basic information used to identify the Data Subject (e.g., name, date of birth, gender);

(b) information needed to contact the Data Subject (e.g., telephone number, mobile number, email address);

(c) technical information that could be used to identify the Data Subject (e.g., IP address, type and version of browser used);

(d) employment information for administering the employment or employment application relationship and process and employee compensation and benefits (e.g., mailing address, social security or national insurance number, emergency contact information, passport, or driver’s license number).

5.3 Information for California residents in the United States:

This Part 5.3 of Daifuku’s Privacy Policy applies to residents of the State of California.  In addition to the other sections of this Privacy Policy, that following rights and disclosures shall apply to California residents:

5.3.1   Sources of Personal data

Daifuku obtains the categories of personal information listed in Parts 3 and 4 of this Policy from the following categories of sources:

Directly from Data Subjects. For example, from forms Data Subjects complete or products and services they purchase.

Indirectly from Data Subjects. For example, from observing users’ actions on Daifuku’s websites or where the Data Subject is designated as a contact by his or her organization.

Daifuku’s websites currently do not respond to “do not track” signals.  Daifuku does not currently engage in the collection of information about consumers’ online activities over time and across third-party websites.

5.3.2   Use of Personal data

Daifuku may use or disclose the personal data collected for one or more of the following purposes: 

To fulfill or meet the reason the Data Subject provided the information. For example, if the Data Subject shares his or her name and contact information to request a price quote or ask a question about Daifuku’s products or services, Daifuku will use that personal data to respond to the inquiry. If the Data Subject provides his or her personal data to purchase a product or service, Daifuku will use that information to process the Data Subject’s payment and facilitate delivery. Daifuku may also save a Data Subject’s information to facilitate new product orders or process returns. 

To provide, support, personalize, and develop Daifuku’s websites, products, and services.

To create, maintain, customize, and secure the Data Subject’s account with Daifuku.

To process the Data Subject’s requests, purchases, transactions, and payments and prevent transactional fraud.

To provide the Data Subject with support and to respond to the Data Subject’s inquiries, including to investigate and address any concerns and monitor and improve Daifuku’s responses.

To personalize users’ website experience and to deliver content and product and service offerings relevant to a user’s interests, including targeted offers and ads through Daifuku’s website, third-party sites, and via email or text message (with the Data Subject’s consent, where required by law).

To help maintain the safety, security, and integrity of Daifuku’s websites, products and services, databases and other technology assets, and business.

For testing, research, analysis, and product development, including to develop and improve Daifuku’s websites, products, and services.

For employment-related matters including, but not limited to, employee onboarding, payroll, and employee benefits. 

To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

As described to the Data Subject when collecting his or her personal data or as otherwise set forth in the CPRA.

To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Daifuku's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by Daifuku about its websites’ users is among the assets transferred.

Daifuku will not collect additional categories of personal data or use the personal data it collected for materially different, unrelated, or incompatible purposes without providing the Data Subject notice.

5.3.3   Disclosing Personal data

Daifuku may disclose a Data Subject’s personal data to a third party for a business purpose. When Daifuku discloses personal data for a business purpose, Daifuku enters a contract that describes the purpose and requires the recipient to both keep that personal data confidential and not use it for any purpose except performing the contract. 

Daifuku discloses Data Subjects’ personal data to the following categories of third parties: 

Service providers (including, but not limited to, carriers and other logistics subcontractors, attorneys, accountants, IT service providers, payroll processors, and benefits providers).

Disclosures of Personal data for a Business Purpose

In the preceding twelve (12) months, Daifuku has disclosed the following categories of personal data for a business purpose: 

Category A: basic information used to identify the Data Subject (e.g. name, date of birth, gender);

Category B: information needed to contact the Data Subject (e.g. telephone number, mobile number, email address); and

Category C: technical information that could be used to identify the Data Subject (e.g., IP address, type and version of browser used).

Category D: employment information for administering the employment or employment application relationship and process and employee compensation and benefits (e.g., mailing address, social security or national insurance number, emergency contact information, passport or driver’s license number)

Daifuku discloses Data Subjects’ personal data for a business purpose to the following categories of third parties: 

Service providers (including, but not limited to, carriers and other logistics subcontractors, attorneys, accountants, IT service providers, payroll processors, and benefits providers).

Sales or Sharing of Personal data 

In the preceding twelve (12) months, Daifuku has not sold any personal data nor has Company shared personal data for cross-context behavioral advertising purposes or to any third parties who are not service providers.

5.3.4   Data Subject Rights

California law provides California residents with specific rights regarding their personal data. This section describes those rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

Each Data Subject has the right to request that Daifuku disclose certain information to the Data Subject about Daifuku’s collection and use of the Data Subject’s personal data over the past 12 months. Once Daifuku receives and confirms a verifiable consumer request (see Exercising Access, Data Portability, Deletion Rights and Correction Rights), Daifuku will disclose to the Data Subject:

The categories of personal data Daifuku collected about the Data Subject.

The categories of sources for the personal data Daifuku collected about the Data Subject.

Daifuku’s business or commercial purpose for collecting that personal data.

The categories of third parties with whom Daifuku shares that personal data.

The specific pieces of personal data Daifuku collected about the Data Subject (also called a data portability request).

If Daifuku sold or disclosed the Data Subject’s personal data for a business purpose, two separate lists disclosing: (i) sales, identifying the personal data categories that each category of recipient purchased; and (ii) disclosures for a business purpose, identifying the personal data categories that each category of recipient obtained. 

Deletion Request Rights 

Each Data Subject has the right to request that Daifuku delete any of his or her personal data that Daifuku collected from the Data Subject and retained, subject to certain exceptions. Once Daifuku receives and confirms a verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), Daifuku will delete (and direct its service providers to delete) the Data Subject’s personal data from Daifuku’s records, unless an exception applies. 

Daifuku may deny a deletion request if retaining the information is necessary for Daifuku or its service provider(s) to: 

Complete the transaction for which Daifuku collected the personal data, provide a good or service as requested, take actions reasonably anticipated within the context of Daifuku’s ongoing business relationship with the Data Subject, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform Daifuku’s contract with the Data Subject or the Data Subject’s organization.

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Debug products to identify and repair errors that impair existing intended functionality.

Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if the Data Subject previously provided informed consent.

Enable solely internal uses that are reasonably aligned with consumer expectations based on the Data Subject’s relationship with Daifuku.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which the Data Subject provided it.

Right to Correct

Each Data Subject has the right to request Daifuku to correct inaccurate personal data collected about the Data Subject. Daifuku will make commercially reasonable efforts to correct any inaccurate personal data it holds about a consumer within 45 days of receiving a verifiable consumer request. If Daifuku requires more time (up to 90 days), Daifuku will inform the Data Subject of the reason and extension period in writing.

Right to Opt-Out of Personal data Sales and Sharing

If a Data Subject is age 16 or older, he or she has the right to direct Daifuku to not sell or share the Data Subject’s personal data for cross-context behavioral advertising purposes at any time (the "right to opt-out"). Please note that Daifuku does not currently engage in sales of personal data but does share personal data with service providers. Consumers who opt-in to personal data sales may opt-out of future sales at any time. 

To exercise the right to opt-out, the Data Subject (or his or her authorized representative) may submit a request to Daifuku by visiting the following Internet Web page link:

Once a Data Subject makes an opt-out request, Daifuku will wait at least twelve (12) months before asking the Data Subject to reauthorize personal data sales. However, the Data Subject may change his or her mind and opt back in to personal data sales at any time by either:

A Data Subject does not need to create an account with Daifuku to exercise his or her opt-out rights. Daifuku will only use personal data provided in an opt-out request to review and comply with the request.   Please note that if Daifuku is not able to share some personal data with service providers, Daifuku may not be able to complete the services for which the Data Subject has engaged Daifuku.

Right to Limit Disclosure or Use of Sensitive Personal data

Each Data Subject has the right to limit the disclosure or use of his or her sensitive personal data to only those actions necessary for Daifuku to provide goods and services to the Data Subject, including for administration of an employment relationship, or as otherwise specifically directed by the Data Subject. Please note that Daifuku does not currently collect sensitive personal data triggering such limitation rights, except for individuals employed by or seeking employment with Daifuku.  This sensitive personal data includes driver’s license, social security, or national insurance numbers, precise geolocations, and racial or ethnic origin. This sensitive personal data is not collected or used for inferring any characteristics about any individual.  

5.3.5   Exercising Access, Data Portability, Deletion Rights and Correction Rights

To exercise the access, data portability, deletion and correction rights described above, Data Subjects should submit directly to Daifuku by either:

Only the Data Subject, or someone legally authorized to act on his or her behalf, may make a verifiable consumer request related to the Data Subject’s personal data. By law, the Data Subject may also make a verifiable consumer request on behalf of his or her minor child (however, Daifuku does not knowingly collect personal data from minors). To designate an authorized agent, Daifuku must have received a written verifiable request from the Data Subject designating that agent by name. Such a request may be sent by email.

Each Data Subject may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows Daifuku to reasonably verify the requester is the Data Subject or an authorized representative, which may include: the Data Subject’s name, address, and any other information Daifuku may require to verify his or her identity.

Describe the request with sufficient detail that allows Daifuku to properly understand, evaluate, and respond to it.

Daifuku cannot respond to a request or provide anyone with personal data if Daifuku cannot verify requester’s identity or authority to make the request and confirm the personal data relates to the requester. 

Making a verifiable consumer request does not require the Data Subject to create an account with Daifuku. Daifuku will only use personal data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. 

Response Timing and Format

Daifuku endeavors to respond to a verifiable consumer request within forty-five (45) days of its receipt. If Daifuku requires more time (up to 45 days), Daifuku will inform the requester of the reason and extension period in writing.

Any disclosures Daifuku provides will only cover data held during the 12-month period preceding the verifiable consumer request's receipt (but may include data that was collected earlier). The response Daifuku provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, Daifuku will select a format to provide the personal data that is readily useable and should allow the requester to transmit the information from one entity to another entity without hindrance.

Daifuku does not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If Daifuku determines that the request warrants a fee, Daifuku will inform the requester why it made that decision and provide the requester with a cost estimate before completing the request. 

Personal data Sales Opt-Out and Opt-In Rights

If a Data Subject is 16 years of age or older, he or she the right to direct Daifuku to not sell or share his or her personal data at any time (the "right to opt-out"). As stated earlier in this Policy, Daifuku does not sell any personal data to third parties, but does share personal data with service providers. If a Data Subject wishes to opt out of sharing of his or her personal data with third parties, he or she should visit the link here https://privacy.daifukuna.com/ccpa-opt-out and follow the instructions above.  As stated above, Daifuku does not knowingly collect the personal data of minors (persons under the age of 18).

Non-Discrimination

Daifuku will not discriminate against a Data Subject for exercising any of his or her California Consumer Privacy Act rights. Unless permitted by the Act, Daifuku will not:

Deny the Data Subject goods or services.

Charge the Data Subject different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

Provide the Data Subject a different level or quality of goods or services.

Suggest that the Data Subject may receive a different price or rate for goods or services or a different level or quality of goods or services.

Retaliate against an employee, applicant for employment, or independent contractor for exercising their California Consumer Privacy Act rights.

5.3.6   Changes to This Privacy Notice

Daifuku reserves the right to amend this Policy at its discretion and at any time. When Daifuku makes changes to this Policy, it will post the updated notice on its website(s) and update the Policy's effective date. A Data Subject’s continued use of any of Daifuku’s websites following the posting of changes constitutes the Data Subject’s acceptance of such changes.
